My name is Ian Griffin, I was in my early twenties when I founded a company called "Griffin Finance Ltd" which I later changed to "Harrington Brooks Accountants Ltd". (check Companies house register for details) I had put everything I had into this business, from coming up with the concept to all my savings and time. As the business proved to be a success I went on and employed my two neighbours and friends, Nick Holmes and Miles Grady to run the sales and book-keeping for the company. I thought, if I had to trust anyone it was better to trust two friends than two strangers. To cut a very, very long story short, my first problem came when I had to make Mr Holmes and Mr Grady equal partners in the company as they had threatened to leave once we were in a position where I could not manage the company without them, as they knew. Doing this I had given them control of my company with 66.6...% of the voting rites together. I even had to guarantee them both £50,000 per year (which was nearly double their current salaries) and a company car out of my own pocket incase the company failed in the future.

A few years later Nick & Miles approached me and asked me, and I quote "Would you like to cash in your shares as myself (Nick) and Miles just want to keep Harrington Brooks small, we don't want to expand any more as you do, we want to keep Harrington as a small family business. I'm sure you can make more money with the cash elsewhere?" Based on everything THEY reported my shares were worth just over £1,200,000. (the actual figures revealed that they were worth 5-7 times that) I then took advice from a friend and accountant who knew Miles and Nick - he told me "Be careful Ian, it's all a bit sudden after all this time....make sure they sign an embarrassment clause. This is a contract to say that if the directors, Nick Holmes or Miles Grady were refinancing or selling the company at the time or within a reasonable length of time, in the future, without my knowledge, I would be able to claim back the difference as it breaches their responsibilities to their shareholders. This act is also corporate fraud and can carry a prison sentence, but the contract makes it much easier and quicker to reclaim the money as opposed to suing and criminal proceedings, which would take years.

Business law is very clear here, the directors must inform the major shareholders of any such activities as they happen or if they know they will in the future (fiduciary duties). The law protects shareholders from dishonest directors (with insider knowledge) buying out shareholders whilst constructing a better deal for themselves without the company owners knowledge or even knowing there is a higher value deal on the table in the future. I called Nick Holmes at the time and said to him "Nick, will you just sign this simple document so I know there is nothing going on now or in the near future that I don't know about? " Nick Holmes would not sign it, in fact he made me feel so guilty for asking and not trusting them I withdrew the contract. He even swore on his child's life..! I felt ashamed of myself for asking. Later that week I accepted their offer.

The next thing I knew Harrington Brooks was all over the Manchester newspapers. Part of Harrington Brooks had been sold for around £15,000,000 according to the press releases. You don't have to be the Chancellor to work out what happened. An honest person might say this deal was constructed by Miles and Nick before they approached me to sell my shares. Never mind the supposed entire reason for the buyout was for Nick and Miles to keep the company SMALL and NOT to expand or sell as I was the one who was always pressuring them to bring in venture capital investment in to grow the business..." which is exactly what they did when they got my shares!

"On his child's life..." was the nail in the coffin for me. It was all about TRUST, looking back I was such a stupid fool. I don't remember a single shareholders meeting I was invited to, despite all the huge changes made within my own company. Directors changed (Nick's own brother) subsidiary companies set up, websites and domains moved, bought and changed. The list was endless and all of this I found out after the sale of my own company. How is this legal? It's NOT!

This company was my life, the feeling of betrayal, loss, loss of trust and self-esteem lead to me having dis-abilitating depression and eventually a nervous breakdown. I was unable to face the stress of a legal challenge at the time. Neither Nick or Miles would take my calls after I found out about the sale. My family contacted Mr Holmes to ask "How could you do such a thing when Ian had trusted you so much and gave you the chance in the first place? " Nick Holmes replied "Get off the phone you silly old cow and don't get involved, tell Ian to fight his own battles" NICE!

A few years later I regained my health and wrote www.CanYouTrustThem.com solely to Name & Shame Nick Holmes & Miles Grady. To my surprise the site immediately attracted 1000's of people every day using it for their own personal experiences too. I didn't write this site to make a living or profit, it is totally free to use. I have never sold any data or made any profits from it in any way. The only revenue generated is from a google advertising banner to finance the up-keep of the website. CanYouTrustThem.com is now currently dealing with 10's of millions in disputes and getting amazing settlements every day!

Within a few days of posting my story last week on the 21/4/2013 Nick Holmes and Miles Grady emailed me, threatening me with legal action bragging that they now have a company Called PayMatters Ltd which is worth £45,000,000 per year and they are now losing business because of my complaint.

It just goes to show in the age of the internet, no matter how big they are or how many lawyers they have, a single person, armed with the truth and a laptop can now stand their ground against what was a lost cause.

This brought another mystery to light, I Googled Paymatters Ltd - it advertises that it was founded by Tax experts. Hmmmm, Miles Grady worked at the ICS Insurance then debt management for as long as I have known him and was certainly NOT a secret Tax Lawyer. Nick Holmes previously worked as a salesman for a mobile phone company prior to the debt management. So, not sure where all their Tax expertise came from???

Here is some insider information: Harrington Brooks was deregulated for VAT over 10 years ago and received an enormous back payment of 17.5 percent of all their clients payments, which to this day, has never been given back to the customers/clients of Harrington Brooks or All Clear Finance, while under the control of Nick Holmes & Miles Grady. If you are a client of theirs or any of their associated debt management companies I would demand between 17.5 & 20 percent (depending on when you joined the programme) of all your payments back. Not to mention all your future payments! I have waited some time to set that cat amongst the pigeons.

Harrington Brooks Accountants Ltd (debt management), under the control of Nick Holmes & Miles Grady, was deregulated for VAT over 10 years ago. As a result, the company received an enormous back payment of 17.5 percent of all their clients payments which, to this day, has never been given back to the clients of Harrington Brooks or associated companies. Even worse, despite being ‘deregulated for VAT, Harrington Brookes continued to charge an equivalent VAT fee - giving the appearance that there was never VAT included in the payment. If you are a client of Miles Grady or Nick Holmes or any of their associated debt management companies (All Clear Finance) - I would demand a partial refund on all payments – somewhere between 17.5 & 20 percent (depending on when you joined the programme). Not to mention a reduction of all your future payments!

Nick Holmes and Miles Grady pocketed millions which should have gone back to their clients. Charging people, already in debt, around 20 percent more is just plain wrong! This payment and future savings on their debt repayment programme could really change their lives. It is sheer greed without a care in the world for those who are struggling and losing their homes on a daily basis.

I now know why Harrington Brooks was valued so highly. The VAT deregulation enabled Nick Holmes and Miles Grady to add 20 percent to their clients payments – which went straight into the companyprofits!

If you know anything about company valuations, you simply take the companies annual profits and factor (times) them by the industry rate (which varies between 4 – 8 times profit). This makes an enormous difference to any companies valuation if you add an extra 20 percent without any extra costs…

What Nick Holmes and Miles Grady did was shameful and really does show their true character. Harrington Brooks was doing very well without keeping the VAT and certainly did not need or deserve it. The people in debt, paying this extra charge, should have got every penny back - at least morally if not legally. Moreover, they are still paying it to this day!

The citizens advice bureau now offer the exact same service and they do not charge the extra 20 percent on top of all your monthly payments.

For legal reasons I can't disclose all the details until my legal challenge is concluded.

Ironically, Nick Holmes and Miles David Grady now operate a company called Paymatters Ltd/ umbrella. This company gives tax advice to the same people - for a substantial fee of course! Neither of these two characters are tax lawyers.

I am a very fair person as you know. If either of you read this which I am sure you will as I have just e-mailed you the link. Take a polygraph if you have nothing to hide. Answer these three question's under polygraph. If you are telling the truth I will drop and remove my complaint. (good luck with that one!)

"Did you make any major changes to the company without informing me or holding a shareholders meeting ?"

"Did you manipulate the companies profits report to greatly reduce the value of my shares ?" (By around 500 percent :()

UPDATE 16/05/2013: It has now been 4 week's since I challenged Nick Holmes and Miles Grady to clear their name by taking a simple Polygraph test. Neither of them are not prepaired to take the test. I do have a nasty letter threatening me and my personal life which is not really what I was asking for, but it does show a very clear picture of Nick Holmes and Miles Grady.

I asked how they will prove and laura (the lady I spoke to) said that there is notes on my file on there system. In my stupid desperation I applied online through the above broker, they said I would have to pay £27.31 for them to match my criteria and pass my details onto suitable lenders. I spoke to one company CFD and had to ring a premium rate number and the call should cost no more than £22.95. I did this then was called back and told to ring another premium number which would cost no more than £15.95, all the time making me believe that these were the actual lenders I was calling and my loan would be available in the next 24 hours or so. Then on the last call he told me that suitable lenders would be in touch within the next few days to finalise my loan applications. All I have had since then are payday loans (I was looking for £10,000 to upgrade my business!) so £1000 is not gonna cut it! And CASH LOAN FINANCE asking me to buy a UKASH voucher so this guarantees the funds but they need to see a guarantee from me first, Indian man calling named PETER JOHNSON which I pulled him up about! Hi

I was desperate for a loan last year and due to my credit rating could not go through the normal channels so I unknowingly contact the above company. I spoke to a very helpful lady on the phone who said I should give over my bank details I was unwilling to do so but she said they would not take any money until the loan was agreed. I said I wanted to think things over and she said that was fine and if I wanted to cancel the next day I could. I then went on the net and discovered that they were a scam so next day i tried the number she had given me to cancel but it was never answered and I then spoke to a very unhelpful man on another number who was quite rude! Just before Xmas they took the amount of �£69.95 from my bank I was furious and rang my bank the Cooperative for help they said if it was fraudelent they would do their best to get the money back and their Visa dispute service would look into it. Eventually they refunded the money back and confirmed the Company was Frudalent. However last week they sent a letter saying that Right Financial have sent them evidence which supports the withdrawal from my account and they will be taking the money back again!! I cannot believe this at all! they say they it is not fraudelent because I have agreed to Right Financial to take the money! but after seeing so many people that they have done the same thing to I am totally angry please can you tell me what to do next? as my bank are being no help at all!

I hired steve to change a turbo on my car, after informing me that this would be a difficult job, he agreed to do the work, after numerous fits of temper and storming off the job a number of times, he eventually completed the job, however my car was leaking oil as a result of his work when I approached him to come back and fix the leak , he responded by swearing at me, expressing his frustration and informing me that his uncle was coming for dinner so he was unavailable, when I asked him about coming the following day he replied saying it was laundry day and he did not want to get dirty.... three days later he came back to investigate the oil leak and informed me that he could not find it... he then removed a major oil pipe from the vehicle and promptly left informing me that he had to collect his daughter from playschool... the vehicle was now immobile and blocking my parents drive, when I asked him when he could come back he replied not for nearly a week as his diary was full.. as I could not be without my car for that length of time I called a second mechanic out who investigated the job and informed me that the oil leak was caused by a couple of missing washers which had not been replaced when steve changed the turbo, subsequently I had to buy a new part and have the vehicle recovered to a garage to have the job completed, I have contacted steve numerous times asking for him to compensate me for the massive expense and inconvenience he has caused me only to receive a letter from him informing me he wont be refunding me ... he is now completely ignoring me.... his negligence caused me to be without my vehicle for 3 weeks and has cost me almost £1100 in repairs and loss of income, I can also prove that at the time he was working on my car he did not have public liability insurance.....

OMG we've just spent nearly £2000 buying a washing machine, a tumble dryer and a Panasonic Fridge Freezer. They were all delivered on Mon (today is Fri). We did as the instructions and plumbed the wash/mach in, put it on a "cleaning cycle" - it leaked all over the floor. Engineer came out the next day - sorted. Same delivery day we discovered that the Panasonic fridge freezer had a "clunk" on the door of the fridge so called Currys TWICE, put through to Panasonic but they were closed. Tues AM called Panasonic directly and arranged engineer for next available time slot which was Friday....

Engineer came this morning and took the door off the fridge to investigate... here should have been a happy ending, an uplift number, and exchange of brand new goods but no it was not like that.....

Firstly the engineer told me that the fridge door was missing and a rubber bush on the door (like a big washer) at manufacturing and therefore was defective. He left as I was on the phone to Currys to report this. They told me to call Panasonic who said it wasn't their fault and I needed to call Currys again. I did....Curry's said they could not exchange it as they need an uplift number (Not true they are required by law to exchange or refund the defective machine at their own cost it was defective from new) Either way I was stuck between the devil and the deep blue sea.

I realised sometime later that, since the "adjustments" by the Panasonic engineer ("I don't work for Panasonic we're just a subsidiary - I can't authorise anything for you I don't have the power"), the fridge is actually now completely broken - the LCD on the front doesn't work and as a consequence the fridge and freezer is now defrosting and all my food is now for the bin.

Brilliant!!! Then a brain wave.....I'll ask Currys to contact where I bought it from (I can't exactly take this back?) and ask them to exchange it for me....( I make no mention of the 2.5 hrs I've spent on the phone dealing with this matter - surely they'll just appreciate this and make it right?)

So the manager from Chester Diva retail park calls me, I forget to get his name and number as I'm so excited to hear from someone from Currys (I've been promised 3 calls back so far) I know, I know, I should have got them. He says to me that a new fridge is going to issued tomorrow and delivered, to call a certain number after 9pm with my reference no and they will tell me what time slot it will be.

Called at 9pm exactly on the number he gave me......ALL CURRYS LINES ARE NOW CLOSED!

Gosh their customer services are second to non...

TOMORROW:

IF the fridge turns up with the same fault I shall refuse it and then drive the hour to the store and demand compensation and a full refund... if not I'm taking these idiots to court.....I'm so fed up with being fobbed off by them like it's meant to be. They actually told me today that they were doing me the favour because they were sending out a brand new fridge freezer, despite the fact that Panasonic had refused to issue the uplift number because I refused the repair........HELLO it's a brand new machine...not a refurb, why should I have to accept a faulty machine???? It seems to me that they have a policy of sending out defective goods and leaving it up to the customer to get them fixed. Rubbish service, rubbish products, rubbish company! DO NOT buy anything from Currys!

Is it my fault if your system is treating this paid advert as duplicate . I don't understand how can you guys penalise your customers for your own technical issues.
This is not the first time this time enough is enough. I can produce all the previous payments I made and my add was being removed without any warning or intimation.
I even tried in past to try to call but GOD knows where your call centre is this is utterly unfair. I am extremely shocked. I am intending to forward this e-mail to fair trading and possibly to the relevant authorities.
Enough is enough.
If these are your policies. Tell me , or show me the second reference of the duplicate advertisement.
Am I entitled to a refund?

In general we do refund ads which are removed from our site, this normally takes 10 working days to re-credit your original payment details. 

However there are some main reasons why we don't issue refunds:-
• If we believe that you are deliberately breaching the Gumtree Posting Rules, we will not refund the payment.
• If you purchase a feature for your ad and your ad goes live with exposure of that feature and its benefits, we will not refund the payment.
• If you pay for an ad and the ad did go live, with exposure on our site, we will not refund the payment.
• Under no circumstances do we refund any payments made on Pet ads or Massage ads.
• If your ad breaches a policy, but only requires a re-write we will put your ad into edit mode and await an update.  Your ad is still active so no refund will be issued.
• If you remove any paid ad yourself, we will not issue a refund.
• Please note our rules regarding duplicate ads, if you post any duplicate ads and pay for these ads, we will not issue a refund.

We reserve the right to remove ads without refund if we feel that our rules or terms & conditions are regularly or deliberately breached.

I need to speak to someone reasonable on the phone to call me. You should correct your own systems before you expect someone to follow.

Please tell me what can I do in relation to that
They have premium number to avoid possible calls. Even if you call them they keep you waiting to make more money?? Its very frustrating this is not the first time it happened. Gumtree just remove the add without warning. How is it possible for someone to study Hundred pages of terms and conditions and how can someone correct himself where there is no intimation about the problem with the advert.
I will be very thankful to you if you could take a notice of it & let me know what should I do next?
