On 27th November I was a passenger in my car which is owned by me. A white van bashed into the front right hand side of the car, 2 men from the van got out, beat the driver of my car up and proceeded to smash my car up causing considerable damage i.e. all windows smashed, wing mirrors smashed, convertible top ripped up.. Everyone disappeared.
Police were called, luckily all 3 (including driver of my car) were apprehended, made statements to the police and were bailed. On 4th of this month they went to court and all 3 pleaded guilty and sentencing will be on 3 March 2009.
It seems as though my car has become an irrelevancy in this. I.e. no one can advice and it seems sentencing will only cover fighting and dangerous driving.
Swiftcover, my insurance company will not cover anything as I wasn't the driver even though insurance was fully comprehensive and the car was stationary at the time. The company that owns the van has emailed saying "The matter has nothing to do with my Company and therefore nothing to with our insurance"
My car is a Mercedes CLK 320 and worth around £7.5K (today's approximate value) it is still impounded until I request for release (I have delayed this as storage costs will start to incur @15 / day.
I have a claim for £6800 as compensation.. But no one is offering advice (i.e. police or Criminal justice unit)

[25/02/2009] Gangly Legs: Sounds like Swiftcover won't cover this claim as the driver of the vehicle was not insured by them - fair enough. Secondly, if the driver was also charged, it suggests a road rage incident possibly and no insurance covers this.The third party owner of the other vehicle would also not be liable for the damage as this is a deliberate act.
The claim could fall to the Criminal Compensation Unit however I am not sure if they would pick up a claim for the vehicle damage and it seems from the thread that they won't. Good luckm in trying them.

[30/03/2009] cash advisor: seems as though your insurer is just playing hard to get, if your car was stationary and it was parked with the key out of the ignition then technically it wasnt in use therefore insured under your personal insurance unless you was working on the day and on a break when this attack happened thus you would have been covered by your business cover claim should be made for vandalism/criminal damage also you can seek a claim through the uninsured losses recovery unit
[01/04/2009] Rob H: You say that you were a passenger in your car at the time of the incident which implies that you were being driven by another party (makes no difference whether stationary or not) the other party (driver) will need insurance to cover them to drive your vehicle ( unless your insurance states any driver)which they may have if they own a vehcile but they will more than likely only be covered third party which would not cover your vehicle if damage caused was due to your driver ( which seems not the case).
The other driver was probably not insured so you should be able to claim accident damage via the uninsured losses recovery unit which your insurance company should help you sort out - thats what you pay them for.
Any malicious damage caused by the other parties would come under crimnal damage but the crown prosecution service normally wants to know exactly what damage each individual caused before they will recommend a charge to court. You should have been asked by the police to complete a compensation for ref the damage which woud have been submitted to the court for a judgement to be made for any possible compensation should the persons be found guilty
