hi. ok here goes. i went in to the carphine ware house in skelmersdale in sepmber 2008 and signed up for a new contract for 18 months with o2. i got the nokia 6500 slide in black. for the 1st few weeks it was ok. then it started shutting down freezing wouldnt work ect. i took it back and got it fixed. with in a couple of weeks it started todo the same again. so i rang customer services up and they said to go in the shop and get a new phone of the same model. well this one started to act up doing the same freezing shutting down ect. i rang custermer services again who said to me ok put this phone in for repair and you can now have a phone of your choice. i went in to the shop explaned what i was told. the lady behind the counter said no that is incorect u will have to have it fixed agian. i argued the fact that i cant keep doing this. i am paying 30 pounds a month for this phone and for most of the time i have had it i have had to take my sim card out and go back to my old old old mobile and use that one. i need a phone on me 24/7 as my nanna is pooly and i have to have a phone on me so i can get incontact with her and for her to contact me. pluse i should be able to use my phone and not worry about it crashing on me. any way they were no abit intrested at all. i have phoned custumer services up and asked to put a complaint in. the man i spoke to said that this model is the worst ever and has lots of problems with it. the people in the shop said the same i even went into another shop called phones for you and asked there appinion on this phone and they said its has lots of problems and when i told them the story they said that if i was told i could have a new phone of another model this is what i should get.. to end my contract it would cost me over 300 pounds. i have looked on the onternet and have read the right ups that people have wrote about this phone and they all say the same. its a bad phone. i have even tried phoning nokia themselves and i was told if i go back to the main menu on the automated call line i would get help and no i didnt. nokia are making a fortune out of this phone and people like me who just want a phone to work take good piccys and send messages ring. have a look on ebay there are lots for sale as people are having to sell them in hope to make money to buy another phone as they are not getting what they want or in my case need. i work with a lad who has the same modle as mine and his is faulty. i have tried being nice ive shouted and im getting no wear. i contated custemer services again and asked if i exstended this contract to 24 months could i have another phone and i was told streight no!!! so i am stuck with a mobile that is going to spend most of its life being repared me having no pone on me wen im in work having to go back to useing my old phone. and i am paying 30 a month for all this.... soon i will have to pay 50 to get it repaied each time it fails. oh yeh i was told by custmer services that if this phone breaks down i can have another model for the same value as this is worth erm hello this is now worth 50 pounds it was worth 300 pound wen i got it but becouse its such a bad phone it has come down in value and if i trade it in with the care phone warehouse they will only give me 50 pounds for it. i have had enough im paying good money for a crap service with no help. im at my whits end we it all. i do not have the money to cancel my contract other wise i would. my hands are tied and what really bites me is the fact that the other mobile phone place said that i should be intitled to a mobile of my choice and that carphone waree house are in the wrong. how much money are nokia making from this and the carphone warehouse people.. i know that this may seem teediouse but you have to understand that i need a mobile and when i got it i was told its a great little phone and when i took it back the 1st time for repair the same person told me that they are always comming in for repair and are a dicky phone so i was lied to aswell. i asked a solicitor for advice and he said i that i should contact you and see if you can help me as for them to take this case on it would cost me 200 pounds an hour. like i have that kind of money... please help me i am tired of it all its not fair and im losing out while they are gaining.

You are not alone in fighting this company. I suggest that you first write to them. (by the way use the spell checker when doing so) tell them briefly that the phone has been returned to the store a number of times because it freezes etc. Tell them that at the time of sale it was faulty (the law says they must prove it wasn't) State facts not fiction. Price up the sim free equivalent model. So ifts a nokia 3g with 100 meagapixel camera that prints pictures from the bottom of it and you want a none Nokia one, then find the price of the none Nokia that does the same. Dont ask for a Rolls Royce when you have a Ford in other words. In your letter demand the cost of the equivalent model and give then ten days to respond or you will commence a claim in the county court for the cost of the replacement equivalent. When tey dont respond go to www.moneyclaim.gov.uk and issue a county court claim for the cost as stated in the letter plus the court fee. It cost about £25 for a £200 claim but you get that cost awarded to you when you win. Now. CPW will probably not defend or turn up for the hearing and they will settle out of court. If they do and your facts are right you'll win. Don't be afraid of the system. You dont need a solicitor just a few pounds and will to not let a big business abuse our rights.
