Meeting Agenda »2009-201008/06/201047

As suggested, now we have Smart ABC's attention (not an easy thing to do when you are a struggling franchisee), we should have a meeting. After all, one of Smart's broken promises in our contracts was to have an anual network meeting with all franchisees invited. I really can't say I'm suprised they never had one, the last thing Smart wants is all those people they deceived coming together under one roof. Then they wouldn't be able to tell you that you are the only one failing, and everyone else is doing brilliantly. Smart should invite all current Franchisee's along as well as the ex-franchisee's. To kick-off, I'd like to see the following items on the Agenda:

1 - Smart MD's son-in-law and ex-Technical Director and now Franchisee (albeit with a much bigger area than other franchisee's are allocated)to demonstrate to us all a repair in under one hour, the repair being carried out under normal circumstances - i.e. drive to customer and perform repair out of a van on their driveway. The repair should be similar to either of the two pictured on the standard ABC leaflet which has the bold red stamp stating "Back to perfection in less than an hour" on top of them. We'll only start timing from when he arrives at the customer's premises.

2 - Smart to present to us just 10 franchisees (they have 90) who have been trading for over a year and have achieved the advertised typical earnings of £90,000.

3 - Smart to explain their continuing adverts such as "All our Franchisees earn between £1000 and £2000 during their first week and are reporting consistent continual growth - FACT!". How can this possibly be "Fact" when over 30 have had to cease trading and many more are struggling?

4 - Smart to explain why they indicated they were BFA members when they were not. Also please explain why you are still not full or even affiliate BFA members. Also please explain the VBRA debacle where you had franchisee's handing out unauthorised leaflets.

The list goes on, but that will do to start. feel free to add other agenda items you would like to be considered below.

ChipsAway Repairs Chpp Away! »15/11/0906/08/201043

Having been given the hard sale at a chipsaway open day, i promptly parted with nearly £40k for the purchase of a franchise.

The training was poor, and the "support" promised from head office was none existent.

Whats more, the paint system is HURRENDOUS.

On a couple of occasions, i was completely unable to match certain colours, and thats before we even get to the lacquer.

Within a matter of months, repairs frequently dull and chip away (perhaps thats where the name really comes from). As a result i frequently found myself refunding customers, and footing the bodyshop bills to rectify substandard repairs.

A friend of mine in the industry told me that the lacquer is without a doubt the worst he knows of....

As a result, I've since had to give up my franchise as it became more and more unworkable, between the poor support and the abismal paint system.

Im sure this can't comply with the sale of goods act...

Smart Success!! »01/07/201010/06/201026

I've gotta say guys, I've spent some time browsing this site, and a lot of the comments on here seem pretty unfair, and in some cases, outright libelous.

I am a Smart ABC franchisee, and have been for approaching 12 months now. I am taking, on average, in the region of £1400 per week. I've had my fair share of technical difficulties, but so far, Ian has always been able to talk me through any troubles i have had.

As regard all this talk of spectrometres being equipment for use on leather???? then why exactly do DuPont produce software updates for using it on car paintwork. and at any rate - if it works, dont knock it - and thusfar, the spectrometre always has worked for me.

I don't know why the business hasn't worked for the other guys on here, but, if it's worked for me, and number of other guys i speak to in the network, im sure it can work for others too - afterall, we're all given the same tools to work with.

Oh, and on the topic of repairs in an hour, yes, i can complete some repairs in an hour. Obviously bigger repairs take longer, but come on, thats just common sense, and in any case, bigger jobs cost more.

I'm not aiming to have a go, just trying to make the point that, as a business model, the smart abc franchise, as far as i have experienced, it is perfectly profitable, provided your proactive, forward thinking, and hardworking.

The other thing i dont think people are taking into account here, is the cost of setting up a franchise on HQ. a spectrometre alone is £4000-£5000. A compressor is in the region of £2k. then theres paints, lacquers, guns, heatlamps.... the list goes one. The bottom line is, at a price of £19,950, (or £10k or £15k depending on when you started) theres not a lot of profit to be made on the franchise fee by "misrepresenting". Smart ABC make there money on the basis of the long term success of franchisees - bear in mind here, a ChipsAway franchise is approaching double this, and the system is inferior, and you have to spend a minimum of £300 per month on materials.

Paint mix System error »Jan 201021/06/201015

[21/06/2010] NOTSOSMARTABC: Nick Bicknell has always made it out that it is only YOU that is at fault and it is your errors that have made it go wrong and everyone else is doing it right... We now know the truth.... They have told lies and misrepresented the truth to sell a product that is very hit and miss.
The Depont paint web site states that errors in colour matching can occur when mixing small amounts, like that of a smart repair. Also can the amounts that these small mixes require realy be done from a dropper bottle ?... if you have a realy steady hand the best you might be able to manage is a guess at half a drop !!!.... and this may well be well over the 0.01 etc that the mix requires. This could mean you have added many times more than you needed to get a currect / close match.....So even if you mix it again because you need more or as happens the customer is not happy you will never get the same mix amounts again.... so much for the guarateed colour match each and every time.
I have heard it said that the best customers are the elderly as they dont look that close and many have bad eye sight !... how wrong can you get...
As for the times of the repairs "Most in under an hour"... I now for a fact that many out there are cutting corners to speed up thier repair times.
For your information SMART ABC HQ have withdrawn the quick quote system as no one was signing up for it.
The well hyped call center has been stopped and any enquiries now go to HQ at kidderminster for anyone passing the phone to answer.

I feel that it necessary to point out that the stories about this company made by others are incorrect. The complainants do not include the full details - i.e. they they themselves are generally workshy, or have alcohol or drug abuse issues, or simply buyer's remorse. Any one interested in a SMART repair Franchise is entitled to the full facts. The SMART Repair Industry is a good and viable one. It provides the public with a low cost opportunity to maintain a vehicle's 'curb appeal'. Without the SMART repair industry's low cost repair option, then we as public citizens would be at the financial mercy of expensive body shops.

The guys at chipsaway put on a great show when they are selling to you. it all starts at £22,000 then with promises of great income & wealth they are emptying your pockets of £45,000. I invested (naively) given their promises of all the work they provide you from so called national accounts and advertising. The few enquries they did send me were not suitable for our repair system. The only work I get is what I make for myself, nothing from the chipsaway call centre. I knew there are a lot of other guys doing these repairs but I did think with the chipsaway promises I would have a better chance, how wrong was I.

Falsely sold franchise »1/7/0715/08/20105
Hi my name is michael Harkin, 3 years ago i looked into a franchise with chipsaway international. It promised with some hard work you can make a decent living with help and support from Chipsaway!! Therefore i signed up to take a franchise in Northern Ireland. The initial investment chipsaway required was £42,500 plus another £10,000-£15,000 to cover salary for the first 6-9 months. After 4-5 months i was struggling to earn enough money to cover my monthly outgoings for the franchise. I asked for help on numerous occassions however help did not come, although it was promised to me by one of the chipsaway directors on the open day that i attended prior to signing up and throughout my training. When i purchased my franchise i was told by the chipsaway directors that at the first sign of trouble with my franchise they would be on the first plane to northern ireland to help me and offer support. These visits nor support never came!Needless to say nine months after commencing trading in northern ireland and a further £2000 later i had to cease trading as i had no income and could not meet the outgoings of the franchise.
Three years later i am still paying for debts ran up by the chipsaway franchise and i urge anyone who is considering this franchise to invest their money elsewhere!

I too fell for this so call SMARTABC. I paid £10.000+£5000 for the franchise
and a kit out the van, guaranteed good income and guaranteed first launch fully book for one month.... what a lotta copper.

Once they got your money your on your own, I didnt even make a penny, had no help at all. On my openning day the owner "Nick" told us that there are atleast 30 thousand cars in your territory and 10 thousand that needs repairing(o yer!).

I came across a problem, which I assumed SMARTABC would sit down and help me, but instead the only advice I was given by Nick was "Pay the customer full on price for the repair at a bodyshop, then just do a few more repairs to get your loss back"... that's not professional advice nor' was it helpful but more of a quick do and a loss in my earnings.

SMARTABC had said that they would guide me through any troubles that I would come across and lead me into profit, instead I have been left on my own struggling to pay the fees for the business, lack of phone support and email, they take weeks to reply or get back to me after leaving tons of messages on there calling machine.

What they promise and guarantee on the introduction and training day is only for that day, once they have a hold of your money, they move on to the new guys for there cash. Typical business scheme!.

I made the mistake of investing some compensation from a car accident into a smart abc franchise in may 2009, thinking that it would be a good way to provide a better life for my family, how wrong could i have been!! from the start you're just fed lies and false claims to try and get you to part with your money and sign into the contract. nick bicknell makes claims about working for defra, having an exclusive contract for the spectrometer, having had the paint scheme exclusively designed for smart abc and how it is years ahead of anyone else, typical earnings of over £90000pa, as much work as you can handle, affiliated with the british franchise association, full professional back-up and support, no failures. If the business is so good mr bicknell, why do you need to lie to get people to buy into it. i am now looking to take legal action against nick, ivan and john seddon from mudie bond because they all played a part in this fraudulent rip off. i would advise anyone looking at this company as a way forward to stay well clear, you'd be better off buying 20000 lottery tickets

Misrepresentation & loan »04/08/201023/08/20103

Well Smart ABC are doing the dirty again. Their Debt Collectors, Daniels Silverman in Liverpool, are threatening court action and possibly banruptcy proceedings even though I have written to them and SMART stating that I dispute the monies owed. The OFT and Trading Standards are investigating the legality of the loan agreement and the misrepresentation claims.

So I appeal to all who have a claim against SMART ABC Ltd to write to the trading standards in Worcester enclosing a COPY of your agreements and open day literature and loan agreement if you have one.

I also appeal to any government body or charitable body that monitors this site to commence investigations into this rip off and warn the general public of this type of business venture

If i had been told the truth i would not have made the mistake of buying the franchise. Misreppresentation »November200915/07/20102

We were all introduced to the Smart ABC Franchise and product during their open days where we were all sucked and drawn into the Smart ABC system and its amazing colour quick pro technique, state of the art system with fantastic colour match qualities second to none on the market specifically for Smart ABC personnel / Franchisees!, The spectrometer which is part of the colour match system was made out that it was specific to Smart ABC! “Which came at a price” And that individual franchisees could carry out customer jobs in 1 hr with body shop qualities! at Half or less than half the body shop price! (Mission Impossible!!!)
I don’t know if any one has looked into the actual pricing of the spectrometer! I have been made aware by a smart ABC technician that he has located a Body shop Smart repair organisation who deal with the public and private sector of the smart repair market! That actually sell the spectrometer, the identical model and system! Only difference is! it does not bare the Crystal clear smart Label!!!!!!and comes at a price of £250.00 it even comes with the same carry case and calibration equipment! Obviously we all are aware that we didn’t pay that price and that we don’t actually have a actual price of the smart ABC spectrometer provided from smart ! But I am sure that every one was informed by the directors and management team at smart that it was or would cost each individual between £4,000 and £6,000 for there product!!!! Ripped of again!!
How many more individuals are going to be put into a Financial Difficult and Embarrassing Predicament being sucked into failed organisation! especially when that they inform every one that they are joining a family who will provide individual help and assistance 24/7 with any issues whether problematic or financial they would help and contact individuals on a day to day basis! This lasted 2 months with a call once a week to none at all!! I have worked night and day seven days a week to advertise and carry out open days to sell my product! And I have had no help from anyone at smart ABC! I have various smart repair companies in my area up to 12 and I have informed Smart and they do not want to know and are not interested in any problems that i have and it is my fault that I have no business !! all I here from smart is spend spend spend how can you spend when you are financially broke due to there so called business ethics. And they are asking for an extra £100.00 on top of there £345.00 management fee!!! Managing What precisely !!!!
The other factor is: mis sold contractual issues with Mercedes Benz (Mudi bond) totally ripped off!
I have nothing what shows or informs me what Mudi bond have provided with the van !! Nothing with Smart ABC Or Mudi Bond specifies individual itemized billing for ant part of the van Equipment Training nothing is documented !!!

Having recieved a large redundancy payout, I was keen to invest in a reputable brand, to secure my future and the future of my family. Chipsaway seemed ideal - they were well established, and Tim the sales guy assured me that they had a failure rate of just 2%! I was promised the world - sipport from head office, a 1st rate paint system, and comprehensive training - and then i paid over my 40 grand....

My franchise and those of nearly everyone i trained with have now failed. I asked for support and help from head office, and was repeatedly fobbed off. The paint system is useless, but your not allowed to buy anything other than products sold through chipsaway and the training leaves ALOT to be desired.

I'm left with nothing to show for my investment and could well lose my home....how do you explain that to your wife and children?

If it werent for the lies and empty promises made by Chipsaway head office i would NEVER have invested. I was doomed to fail from day one... the franchise is scam and the directors are con artists.

I was close to loosing a lot of money investing with chipsaway.
It is NOT the success story they try to tell you. I had done the open day talked to their guys and naively believed the story ready to pay my money. By chance I met one of their franchises in my town.
I was surprised as they had told me that there was not another guy in my area and they had lots of work for me. After speaking to this guy he told me a very different story - massive failure rate and no support when you ask. I did some more research and spoke with some more chipsaway guys, same story all struggling and failure. It appears the failure rate is eye watering and very sad for the families that are loosing huge sums of money and then left with great debt!! I can't believe how chipsaway get away with it. the BFA must know so why do they not stop such bad practice. If your interested in chipsaway do some extensive research and you will run a mile like me. I will not be investing in any franchise now!!!

Peel2Save - misleading sale / possible fraudulent conduct? »16/06/12 to date30/06/20122
To document everything that I feel was misleading about Peel2Save would take far too long to type here, but this Franchise/Biz Op was sold on the basis that it was the same as used in the US for close to 10 years (this appears to be not the case), it was a massive success in Solihull where it was extensively tried and tested (it doesn't appear to have been tested thoroughly nor overly successful), national brands were advertised as being on board and just waiting for our call (they weren't) and the business model as sold DOES NOT WORK and N5 have tried to revise it time again without apparent success.

If the information given by Nigel Botterill in order to sell Peel2Save was just totally naive and over egged excitement then Nigel Botterill has clearly shown himself not to be the big business guru he makes out, as he appears to have left 100's of people in debt or seriously out of pocket, whilst having done very well from it himself, thus resulting in a massive blow to any reputation he had before hand.

If Nigel has deliberately misled 100's of people with false claims then his conduct is tantermount to a criminal fraud in my opinion.

The second very big issue with Peel2Save with a recent revision of the business model, is the introduction of an affiliate scheme whereby despite businesses, charities and consumers believing that £5 from every card sale goes to charity, only £1 does. Nigel defends this by saying that the scheme is optional and a charity is better off getting £1 than nothing at all.

I have to disagree. If a business appears on the card with an understanding that £5 from every card sold goes to charity, a charity agrees to be a beneficiary of Peel2Save on that same basis, and consumers by the cards also on that basis, then giving anything less than the marketed £5 to the good cause or charity is fraudulent.

Whilst most Peelers have chosen not to run this scheme on ethical grounds, just one area doing so and being found out can potentially damage the already dwindling reputation of Peel2Save nationally. By proposing such as scheme I believe that N5/Nigel Botterill are ultimately liable.

Misrepresentation of Facts. »November 200920/05/20101

I fell for the sales patter of Smartabc at one of their open days, And paid the £500 deposit. I and others where told at this time , when asked about the failure`s, we were told only 2 had failed, but these were not failures, as 1 went through ill health and the other was a lapse in judgment By Nick , because it was sold to a young lad, who was either a relation or close friends boy, who was not responsible enough , due to his age, when in reality there were 15 failed Franchisees and many more struggling , if I was given the real facts at the time then I would not have parted with the £500. Also I was persuaded to take on another area, not the one I first wanted, as this would be a far better postcode for me and would generate a better income, this area turned out to be in a failed Franchisees area, who was in dispute with Smart at the same time, I was given the impression at the time I was the first person to work the area, I should have been told the facts at the time. The repair time is also a fairy tale, it still says on the sales patter, that " most repairs can be done in one hour or less " this I now know to rubbish, the trainers at the Smart Base site would not be able to repair a car in that time, unless it was a case of polishing out a shallow scratch. The claims they make of being able to make £1000 - £2000 a week are not realistic , and as many people have found out to their cost, to get enough work to cover your running costs, you will be lucky. I do not know of one single person to date that has been able to pay their selves a reasonable wage. My understanding at the present time , there is a 70% Failure rate. Be WARNED steer clear of this Franchise.
