Sales of Goods Act 1979. Dear Sir, This is a continuation of our phone conversation. I am writing to bring this matter clear to you. I bought a car (MAZDA 6) from your company on the 31/10/11. Before this date I made a deposit of £200 on the 29/10/11. Hereafter I made the remaining payment of £1,400+ toward the purchase of the car. Final payment of the car mentioned above. On my way back from your shop with the car I purchased from your company, I noticed white smoke coming out of the bonnet of the very car I bought from you. I packed up this car and called the staff that dealt with my by the name of Charlie. I told him of the problem asking him to come and take the car from the place it developed the problem which was few yards away from his work shop, the shop of purchase. Charlie said they were closing and he cannot come and collect the car. I tried to convince him to come and collect the car, but he refused to come and collect the car. Left with no option I called the RAC requesting for help. RAC charged me the sum of £140 to be a member. They (RAC) also mentioned to me the payment would have been made over 12 months but because I was in need of their service I will have to do the whole payment at one’s. With the help of my wife I made this payment and got their services. This car (MAZDA 6) was then towed to my residential address on Monday, 31/ 10/11, where it stayed till Wednesday 2/11/11 before it was towed back to the workshop, where I bought it. While it was still on the way to the work shop, I called up Charlie letting him know of the car and the towing truck being on its way to him. On this conversation I made mention of the money I paid to the RAC, asking him what he was going to do about it. Charlie told me to leave that for now he will sort it out after the car is fixed. The car was with them till Monday 7/11/11, which is the day I collected the car again. On the Saturday 5/11/11 I called up Charlie again asking him of the refund of the RAC, he said “I will refund you the money” and also he said “Your car will be ready on Monday 7/11/11 and to call him before I left to him/ his workshop”. Came Monday 7/11/11 morning I called him and he asked me to be at his workshop after 2pm that Monday. I did as he said. On getting to his shop, he showed me the purchased car and told me he changed the faulty parts of the car of which he failed to show me the old parts. I took his word for it. So I mentioned to him about the refund he told me and he said ‘We go half on the refund, as he got a tow truck to come and collect the car from my home address’ I told him ‘You had the chance to collect the car when it was yards away from your work shop on the day it happed’ he said ‘leave it with me call me when you get home, I will send you a cheque tomorrow’ I called him when I got home and he said ‘He had had a long day and he will sort the matter out the next day’ being the 8/11/11. I called him up again the next day and he told me to wait until his business partners came to work at 1pm. I waited pass 1pm no call from him. I called him again requesting for my refund he said they hadn’t come to work yet and that he will call me as soon as they come to work. Charlie still didn’t call me. During this time of waiting my wife took the car from the drive way to the front of the house only to notice a puncher on the front right wheel. I decided to change the tire only to find out that I had no spare tire in the car. During the purchase of this car, I entered into a two year warrantee agreement with them, the company and after fixing the car, which I expect if anything goes wrong with the car within two years they will fix it free of charge, but Charlie said he did me a “favour” by fixing the car. So all am asking for right now is to refund me the £140 I paid for the RAC, as that money was mapped out for the insurance of the purchased car. And if this is not refunded between 14 working days, I will like to give the car back and get my whole money back. I also made this clear to Charlie and he said to me they don’t do refund. To add on this complain I am very disappointed with your service. All the time Charlie said he will call me back he never did. The only time he did was to tell me the towing truck was on its way to me. I hope to receive letter from you on this matter. Hopefully a letter to resolve this matter. Just wish we had found this site before buying my son's car today 25/3/12. Looked at it Weds21/3/12, MOT out (failed on n/s tyre tread dangerous, brakes + couldn't inspect under bonnet as couldn't be opened. Told they would do everything & get yrs MOT, touch up paintwork ready to collect today. Asked about warranty stated on web site, told yes 2 yrs free, so paid �£500 deposit. Collected it today, told they couldn't find the MOT cert, but shown online it had passed. Asked them to open the bonnet to check it had been repaired, they did & it looked OK. Asked for the warranty papers, told they couldn't be issued until log book changed,. So I asked what happens if there is a problem before then, told not to worry, they would just issue it early.Paid & left for the 50 miles back home. The car barely made it, kept losing power & when he went to lock it at home, the lock must have had something like a screwdriver rammed in it & wouldn't work. Called & said not happy, taking it to garage. When they looked, there is diesel spraying all over the engine, 1 tyre at least (yes n/s) is illegal, the turbo is on they way out. All in all we've been had. Called them & told to call back Monday, don 't think the car will even make it back, even if they would do the work & illegal to drive it anyway. We can't drive it without tax & now find we can't tax without MOT. Going to trading standards tomorrow but don't have much hope. Checked the agreement he signed, it says the car is sold as spares or repair! Looks like this is the way they trade. BEWARE! Trading Standards have saif their contract is illegal and advised going through small claims court as they don't respond to phone calls or registered post. Have also contacted VOSA (without the car being touched) as I think the MOT is dodgy.

On 24/08/2012 I purchased a car from this dealer. It is a Vauxhall Meriva, 04 with 108,000 miles on the clock. The hinges on the boot did not work and they offered to fix this before I took the car. This they did.
After I had collected the car and on the way home I asked my daughter to check the date on the MOT form.Five Star Cars claim to sell all their cars with a full MOT. It did not have one. I took the car back and they did an MOT and delivered the car back to me. The driver that brought the car back said they had replaced two cv joints and the end piece of the exhaust. Whilst driving the car I noticed it was very noisy and took it took a mechanic I have used in the past who advised me NOT to drive the car as it was unsafe and not roadworthy. Only one cv joint had been replaced and that was faulty and leaking oil. The exhaust had not been touched.
I was told by 5 star cars that they would refund my money on 05/08/2012 and the gave me a time of meeting for 3pm on 06/07/2012. I went to the garage and waited for an hour. I was told that Ossie ( the gentleman who delivered my car would come and retrieve the car and refund my money ). No-one turned up and I was told the following day that my money would not be refunded and my local mechanic could not repair it.
Obviously they do care about their customers and families. Without a car I have great difficulty taking the children to school and caring for my wheelchair bound Dad. He cannot get out without my aid. I will be making a claim against this company and reporting the invalid MOT to VOSA. I would recommend anyone using this company to take a mechanic with you.

I was buying a citroen c4 from the former 5star cars and while going ahead with the sale they pretended they couldnt find the paperwork for the car (mots, hpi, logbook). They said to come back again when they find it and i opted to put down a deposit so that i wouldnt lose out on the deal. I left £250 on the car on rhe condition that i would go ahead with the sale as long as the hpi is clear, mots and logbook were present and that there was no more than two owners. I was told to come back on the thursday. They were actually closed on the Thursday and told me to come on Saturday when i was ready to come down.after i gave them a bollocking they said to come on the friday.
I arrived on the friday morning and they were cleared out completely gone, no trace of them. I am now going through the police to try and get my money back. An aggrieved employee that i met outside 5 star cars has now informed me that 5 star cars is now known as HEATHROW CAR SALES in bath street,hounslow.
They have put the car they were supposed to sell me on their new website, which says it a really...

I wasn't going to say anything, but the more I thought about it, the more upset I get. I figured with all of the hype around this cash for clunkers pitch the government is offering, we would go down and see what we could do. I have driven GM products a long time and they have always been good to my family. My wife, two sons and I all have GM products and it has made us sick to see the company go down the way it has.


The dealership we visited is right off the highway and they have always seemed to have good trucks on thier lot. We pulled in there Friday night to see about a trade. Now I know it was after 8:00 when we got there but I figured somebody would want to make a sale; I was wrong! The closest I got to anyone being interested in us as customers was to have a card handed to me. They told me we could talk to some guy named Marty when he was around. That was it. we looked in the windows of some nice trucks, stood around for a while and left. We won't go back any time soon.


As we went on into town we ended up checking out both the Ford and Toyota dealerships-I have always liked the F-150. I hope GM makes it, it is going to need better customer service then we got, that is for sure. The way I see it, it cost us $4500 and the dealership a sale.

I recently bought a car from this company and I can honestly say it was a dreadful experience. 5 Star Cars, are also known as Credit Crunch Cars, also called State Motors in Brentford. They sold me a car with many issues and definitely not fit for purpose. They continuously bullshit you and distract you so you cannot look at the car properly. They provide untruthful information and any issues with the car they promise to repair before you pick it up. Once you pay them a deposit, that is it. They told me that, as agreeed, the car had been serviced and they stamped the service book in front of me. However, no service was ever carried out (fraud?). The MOT was also dodgy, as I discovered shortly after, the car had major mechanical issues and should have not passed the MOT. I am in the process of putting a formal complaint to VOSA. The car is basically a piece of crap and when you complaint to 5 Star Cars (AKA Credit Crunch Cars, AKA State Motors Brentford) they are just not interested. They swear at customers that complaint. The worst one by far is Mr Charlie Kahn who I believe is one of the owners. He is just nasty, inside and out. The others are not any better, just less agressive, but they are just dodgy. They knowingly sell dangerous cars to decent people with children, nice one!! They have been doing this a lot lately, I have already spoken to 6 different people that have been ripped off by this company. They keep on changing their name, 5 stars cars, credit crunch cars later, next one may be Hose Pipe Ban Cars... the fact that they regularly change their company name on the same premises speaks volumes about their reputation!! They never send the car paperwork to the DVLA, so you never receive the logbook. None of the 6 different people I have spoken to that bought cars from them in the last 3 months have received the logbook, which probably indicates that the cars are dodgy. They also make you sign a contract that states that the car is sold for parts (implied that is unsafe for the road). However, they sell the cars to you clearly for personal use.  In addition, their contract is illegal on the grounds that does not comply with the Sale of Goods Act which covers the sale of vehicles to end customers. They bully you to try to get you to pay in Cash (dodgy books?). I cannot believe how companies like this one can get away with putting dangerous cars on the road and risking the lifes of decent hard working people. Once you pay the deposit you are in a catch 22 with them and they are mafia. There are several court cases open on this people and they just continue operating and changing their name. They advertise the cars on Autotrader, but also have got at least 2 websites: 5 STARS CARS IN BRENTFORD and CREDIT CRUNCH CARS in Brentford, Unit 2 and 3 Commerce Rd, Brentford, TW8 8LE. If you experience isues with this company, please contact Trading Standards and Consumer Direct, report them! Also call VOSA and challenge the MOT if the car is faulty. VOSA will inspect the car again and if issues are found where the car should have not passed MOT. Call also DVLA and ask them if they have ever received a logbook with this company name as a trader...that is the thing about chaging company name frequently, nobody knows you. Do not be afraid of calling official bodies to ask about the reputation of this company, they will know about them!! If you are looking for a car, avoid this company, and go to a reputable dealer instead. Avoid, avoid, avoid!!! if you dont wish to pay for the lifestyle of people that have no morals, no decency, no regard for the safety of human beings and definitely no regard for UK law or any due diligence, just for filling their dodgy pockets, then keep clear from them! I purchased a car a few months ago from JMCC Autos and wanted to share my experiences of them. I'm sure that some people have purchased without any issues, but unfortunately I did not!

The day after my wife and I found out she was pregnant, my wife's car decided it was going to die which was not the best timing!! We decided that she needed to buy an economical, reliable car and I was keen on getting a Polo for her. I trawled through autotrader and found a few that I liked, one of which was from the mentioned trader. I called and spoke to Jason, who is JMCC Autos, and asked specifically what condition the bodywork was in as we would be travelling a couple of hours to see the car and I wanted the bodywork to be in top condition - Jason told me that there wasn't a mark on the bodywork.

When we arrived to view the car, it was clear that the bodywork was far from spotless and that is where this story should really end, but as my wife was desperate for a car that weekend so she could get to work on Monday, we'd come so far and the wife wasn't that bothered about the marks, I decided that we'd buy the car.

There were various complications paying for the car as the banks were shut but we managed to transfer money via my smartphone (god bless technology!!) and purchased the car. Jason had made us aware that he'd noticed there was only one key and as he used to work at a VW dealership he could get one for cheap which he'd then send to us, we could get programmed and send him the invoice to be reimbursed. I thought that was a fair arrangement so we left with the car and the expectations of receiving a key the following week.

Unfortunately this did not happen! I waited a 2 weeks and rang Jason to be told he had ordered it, it had been delivered to the dealership and he simply had to pick it up and post it. He also said he would send it registered delivery and ring me to tell me it was on its way. This, again, did not happen and after another 2 weeks of waiting I tried to ring Jason to find out what was going on. Unfortunately, he would not answer any of my calls. Over the next few weeks I tried ringing multiple times and eventually sent Jason an email. Rightly, or wrongly, I pointed out in this email that I wasn't happy with being given the run-around and, as part of a small business myself, I thought that customer satisfaction, trust and reputation were key traits for success. I did also say that unless the situation with the key was resolved I would post details of my experience on VW forums as I thought it fair (and my right) to share my experience with others.

Subsequently, I tried calling multiple times and leaving voicemails, all to no avail. Finally, I rang from a different number only to have my call answered and when I confronted Jason about the lack of communication and the lack of delivery on his promise, he used my "threatening(!)" email as justification for not sending me the key - even though he'd been fobbing me off for over a month. He said he would not provide me a key, so now after parting with our entire savings, months before having our first child, I have no choice but to spend out another £150 to get a key myself.

This is an accurate account of my experience and I hope that people might find it useful.

I bought a Citroen C3 from 5 Star Cars on 28/06/2012 (it was my first car which I bought in this country). Of course like in all stories they couldn't find MOT certificate. I paid in total £2380 with a warranty. 29 June 2012 I found out that car mileage was clocked back more then 55000 miles!! I returned a car straight away to them and asked for a refund. I refused to keep a car as I read that if you refuse a car, you can't use it. They tried to tell me that it's some kind of mistake and they have to investigate it. After few weeks of arguing and sending letters and showing HPI certificate they said they will refund me money to my account, but they didn't.. So I started claim online. I followed step by step claim procedure. To my claim I added cost for a petrol (as I gave a car back with a full tank of petrol), for a new wiper blades (they gave me a car with ripped ones), for court fees, for a caused stress as I didn't go to work for 2 days as I felt sick. It took a while when I could request a judgement. I needed a judgement to start High Court enforcement because anyway I didn't receive any information or money from them or from county court. Then I started High Court enforcement and it took really long time (3-4 weeks) for County court to send my documents to High Court Enforcement and during that time Whatchdog program came up.. And after that program 5 Star Cars run away from Brentford.. So I paid court fees and was waiting for such a long time for nothing.. as now I can't get my money back when company is not trading any more.. What shall I do in this situation..? If claiming process didn't take so long or County Court wasn't sending my documents 3-4 weeks, so I would have my money back by now.. I took a loan in the bank to buy that car and I'm still paying it.. Could someone advise me what should I do in my situation..?
I found a comment that 5 Star cars moved and opened another company, but I could find anything with provided information in that comment. Can I go to police and declare my situation as a criminal offence and say that company director Asif Adnaan http://company-director-check.co.uk/director/916013787 (if he really exist) stole my money and has my car? Will police help me to find them and get my money back..?
Please anyone help me...

P.S. I think they were faking MOT certificates, because when they gave me MOT certificate number and I checked on DVLA, mileage was ok, but HPI Certificate showed different.. These thieves have to go to jail!! They are criminals, I don't understand why police is still waiting.. there is so many evidence what they've done.

I am deaf lady.  It was all my first time thing was happen to my car..  My fiance and I bought the car with no credit check. We have been pay on time since April.  We paid for May was late for few days for the payments. I never thought it was fast happen.  I got the letter was on 5/15/09 was about past due  (NOT letter about repossessed).  Till Monday 5/18/09,  I was about to call them abut the payment. End up my car was gone as towed for repo without warning me.. I was "thought" as stole car but I had to call the company and does not want to discuss with me on phone with Relay service.  I had to call my father to help me out to call them.  They told him dont bother call them.  We had to drive over there and say must make an appointment.. So, we made an appt on 5/19/09 at 10 am to meet owner name Al.  We met them and Al was yelling at my father with bad attitudes and wont sit down and to discuss solve the situtates.  He was not very polite for the business.  It is rip off for wrongful to repo my car without warning.  He turned the letter as repossessed as present front of me.  Did not give me chance to get my stuff from the car with my DL, ATM, papers information.   I just want to let everyone not to buy from there.   I am single mother with 4 children with no car.  Please help me if there any possible to get my car back..

Bought a Range Rover 1995, from Dennis Firmin who pretended to be a private seller. Now we know he is infact a dealer "Dennis Autos".


In the add he mentioned that the car "Drives very well". After a test drive we bought the car. 3 hours later the car stopped driving. After independent advice from a gear specialist he told us the gear box was bearned out and this is something that couldn't be there just after a few hours driving.


Dennis Autos has refused to refund and take back the car. We had to repair the car for 1500 pounds, in the beginning Dennis refused to give us any payment. After a lot of time and effort he is now willing to pay only 200£ which ofcourse is unacceptable!


If anyone  can give us advice what to do, please let me know...

I Financed a Vehicle from Mr.Repo under the impression that it was a reliable Vehicle (just like many other consumers would.) and after a week the Vehicle starting acting up. Yes it was under the As Is warranty, but what I thought As Is meant Is an automobile that is in a condition of what a vehicle is suppose to be. The Car Is rigged up there are wires running everywhere and some just hanging out and there is a horn right in the front of the car. I had the vehicle looked at by there mechanic and he said that there was no major problems wrong with the car and it needed light  maint. like a tune-up and it had weak motor mounds and I agreed to fix it but now it comes to my attn that it has way more problems and the owner agreed to fix it but i do not want the car because i know dwn the road it will cost me a lot of money financially to fix the car, so I asked him for a refund of my down payment OR another vehicle off his lot and he said no to both and he said its not his problem, (and he is the manager) he also said not to call him anymore because we keep going in circles I told him its not going in circles if we both come to an agreement not only what he wants,and he is not considering my needs. I told him that the vehicle is rigged up and he said he had people driving it before  and it never had a problem that doesnt mean its a reliable car. I have had nothing resolved I dont even want vehicle from him b/c his methods are coniving and money hungryMoney mouth. I just want my money back to get a reliable car to go to school and work.

In the beginning of June I bought a Nissan from Royal Oaks Chevrolet in Paducah.  First let me state that it was the worst experience I have ever had purchasing a vehicle.  The tactics that were used were almost criminal; however, I am the one who ended up being a criminal. 


Upon purchasing the Nissan, I requested that my license plates be transferred from the trade in to the new vehicle.  The plates were removed from the trade and placed on the Nissan.  I believed and trusted that all was well.  Approximately two weeks later, as I was driving out of town in Illinois, I was stopped in a routine traffic stop.  During which time I was ticketed because the plates were not transferred to the new vehicle.  Convinced this was just some kind of misunderstanding, I contacted Royal Oaks who was very apologetic and stated they would have temporary plates and a check cut for the price of the ticket brought to me at my place of employment.  Over a month goes by, and numerous phone calls and stops by to see them just kept giving me the run around.  Never mind the fact that in Illinois your driver's license is taken as bond on the ticket.


I was able to speak with the general manager and he stated that because I cancelled my extended warranty that somehow that makes him not responsible for the fact that I have a ticket.  He continued to state that since his name wasn't on the ticket he wasn't responsible.  Because I cancelled my extended warranty, it caused him to have to pay a fee, so we were somehow "even".   According to the warranty paperwork, and the phone call I made to the warranty company, I had every right to cancel the policy without being charged. 


I think it is important for people to know that they need to be careful when purchasing a vehicle to make sure all of the paperwork is correct.  Obviously this dealer doesn't care about the people who buy cars there.  So now, I'm stuck with a $75 dollar ticket, no license and a court date... my vehicle was booked in for repairs at vauxhall . i had paid paid 1300cash for repair apparently fixed they said. i drove the vehicle for half hour. by than (engine maintenance ligh)t came on. this meant vehicle to be checked by dealer. i drove the vehicle back as now it was losing power. i claimed for the vehicle to be inspected.technician/mechanic said without checking the vehicle. drive on motorway high revs the vehicle will be okay!!!.i took his opinion into account i than drove on motorway. now the vehicle has stopped a red light has come on and have turned off the vehicle. i than booked a recovery by AA. the engineer checked vehicle and gave a full report of vehicle. it stated loose nuts and bolts on top of the engine. insufficient water in radiator!!. this meant vehicle was not checked and diagnosed once left dealership.i took this complaint with manager and has not helped me and has told me to issue proceedings. pls pls help!! as it is a new vehicle 08 reg!!

When we bought our car at that dealership, we were promised an extra key to sent it to our mailing address within 7-10 business days, and a 100$ referral check to my husband's dad since he referred that Company to us. That was almost 3 months ago, and we haven't receive our extra key and a promised referral check for my husband's dad. We have contacted our sales person many times and conversations with several managers, but nothing happens.
There were several excuses for not receiving our extra key and the referral check, even managers always promised to call us back for what ever they've find out about the problems, but even managers do not call back.

I have purchased 2 other cars from this lot, the 2nd car was sold with the check engine light on, i wanted to have it checked out but was convinced by the salesman that the car had a warranty. Needless to say the cars catalytic converter was the cause of the check engine light. Obviously the car was not smogged, i paid that car off and got into a accident, traded it in towards this 3rd car, a 03 Acura TL, less then a month later the 3rd gear in the transmission went out. I went to the lot asking for their help, in fixing it. They wanted 1500 up front and 1500 added to loan! 1st problem is i just bought it less than a month previous, 2nd problem is they said i bought it "as is" but when looking at my paperwork the paper was not to my Acura but a Toyota 4 runner. i became 3 weeks late on my payment, and on Easter Day they repossessed the car

i sued the above person whom owns the car dealership and won a judgement of 500.00 plus 85.00 in court cost plus since then i have filled more papers trying to collect my money at the cost of another 85.oo also it is ordered that he will pay interest from time of judgement to date of payment. everytime i try to have him served they say he is not there his name is chris coier. it has been three years trying to collect for a car he sold me that had a blown head gasket and know about it

I was looking for a car in the autotrader when I came across a company called custom auto design I called them to view the car I viewed it and it was great next day I gave a deposit of £100 to secure it. Following that 2 days later I gave them £4000 and the remaining £1000 would be paid on the day of collection I visited the dealer several times and they told me that they had sold the car as I didn't pick it up in 24 hours and that they had taken my £4100 as admin costs and now the man who I dealt with threatened to beat me up if I turned up at his dealership and my money is gone as I didn't Pick up the car 24 hours but I had already arranged to pick it up a week later
